Virginia trespass and posting laws

What makes land legally posted in Virginia?

Land is posted by signs prohibiting hunting, fishing or trapping placed where they can reasonably be seen, or by paint marks on trees or posts at each road entrance and next to public roads and waterways. Posting is not required to prosecute: hunting any land without the owner's consent is itself a crime, but posting raises the penalty.

Statute sets no minimum sign size or spacing.

Does Virginia have a purple paint law?

Yes. A paint mark must be a vertical line at least 2 inches wide and 8 inches long, centered 3 to 6 feet above the ground or normal water surface, at each road entrance and next to public roads and waterways. DWR prescribes aluminum or purple paint.

Do you need written permission to hunt private land in Virginia?

On posted land you need the owner's or agent's written consent, or the owner or agent must be with you. On unposted land you still need the landowner's consent, but it does not have to be written.

The statute does not expressly require carrying the written consent; carrying it is the practical way to prove it.

Can you retrieve a deer or a hunting dog from posted land in Virginia?

Fox and coon hunters may follow their dogs onto prohibited land when the chase began elsewhere, and other hunters may go on to retrieve dogs, falcons, hawks or owls, but without a firearm or bow and without hunting. Using a vehicle needs permission, and refusing to identify yourself to the landowner is a Class 4 misdemeanor. Tracking dogs on a lead may be used to find wounded deer, bear or turkey only where the trackers have permission to be on the land.

DWR reminds hunters that tracking or retrieving wounded game on private property requires the landowner's permission.

What is the penalty for hunting trespass in Virginia?

Hunting, fishing or trapping on another's land without consent is a Class 3 misdemeanor (fine up to $500). Doing it on posted land without written consent or the owner present is a Class 1 misdemeanor (up to 12 months in jail and/or a $2,500 fine).

Destroying or taking down posted signs is also unlawful (DWR).

Can you hunt from or near a road in Virginia?

It is a Class 4 misdemeanor to discharge a firearm, crossbow, slingbow, arrowgun or bow in or across any road or within its right-of-way. Shooting from a vehicle is also unlawful, and counties and cities may ban hunting with a firearm within 100 yards of primary and secondary highways.

What are legal shooting hours in Virginia?

Game animals and nonmigratory game birds may be hunted from one-half hour before sunrise to one-half hour after sunset. Spring turkey closes at noon except the last 20 days of the season.

Furbearers and nuisance species may be hunted by day or night (muskrats by day only).

What are the blaze orange requirements in Virginia?

During any firearms deer season, in counties and cities designated by the Board, every hunter and anyone with them must wear a solid blaze orange or blaze pink hat or upper-body clothing visible from 360 degrees, or show at least 100 square inches of blaze at shoulder level. Enclosed ground blinds need 100 square inches displayed on or above the blind. Muzzleloader-only season deer hunters must wear blaze unless in a tree stand or other stationary spot.

Fine is $25. Exempt: waterfowl, dove, dog field trials, fox hunting on horseback without firearms, archers where firearm discharge is banned. DWR applies it to youth/apprentice deer weekend too.

Is night hunting legal in Virginia?

Killing or trying to kill deer at night with a vehicle light, spotlight or flashlight is a Class 2 misdemeanor and costs your license for 1 to 5 years; shining from a vehicle while holding a weapon is presumed an attempt. Furbearers and nuisance species may be hunted day or night.

Do you need a hunting license to hunt your own land in Virginia?

No license is needed for landowners, their spouses, children, grandchildren and their spouses, or the landowner's parents to hunt, trap and fish on their own land. Bona fide tenants and lessees who live on the land are exempt if they carry the landlord's written consent.

Who needs hunter education in Virginia?

A hunting license cannot be issued to anyone who has never held a hunting license anywhere, or to anyone under 16, without a hunter education certificate. Residents under 12 may hunt without a license (or buy one without the course) if accompanied and directly supervised by a licensed adult. A one-time, two-year apprentice license defers the course if the holder hunts with a licensed adult over 18.

Not required for fox hunting on horseback without firearms.

Is Sunday hunting legal in Virginia?

Yes. Sunday hunting is allowed, except you may not hunt with a weapon within 200 yards of a place of worship or its accessory buildings, and you may not hunt deer or bear with dogs on Sunday.

Virginia baiting, crossbow, drone and trail camera rules

Is it legal to bait deer in Virginia?

No. It is unlawful to hunt from a baited blind or place, or to put out bait or salt to take wild birds or animals. Separately, feeding deer is illegal statewide from September 1 through the first Saturday in January and year-round in CWD-management counties, and feeding bears is illegal year-round.

Baiting nuisance species and baiting traps for furbearers are allowed. Food plots and normal agricultural crops are not bait.

Can you use a crossbow during archery season in Virginia?

Yes. DWR lists crossbows as archery tackle, so they are legal during archery seasons for any licensed hunter, as well as in muzzleloader and firearms seasons.

Can you use a drone to scout or recover game in Virginia?

You may not hunt, or help someone else hunt, on the same calendar day and the same property where a drone was used to locate or scout for any wild animal.

Virginia landowner liability

Is a landowner liable if someone gets hurt hunting on their land in Virginia?

A landowner owes no duty to keep land safe for, or to warn, people using it to hunt, fish, trap or for other recreation, and giving permission does not make them an invitee. The protection does not apply to gross negligence, willful or malicious failure to warn, or when the landowner charges a fee.
